Jurisdiction and Venue in Tennessee for DivorceTo have jurisdiction and venue in Tennessee to file a divorce action, the following rules apply: A. Venue is determined pursuant to Tenn. Code Ann. § 36-4-105 in that (1) the parties were living in a Tennessee County at the time of the Parties separation or (2) the Defendant is presently residing in a Tennessee County or (3) the Defendant is presently residing in another State (or is a convict) and the Plaintiff resides in a Tennessee County. B. Jurisdiction is determined pursuant to Tenn. Code Ann. § 36-4-104 which requires that the acts complained of in the Complaint (1) were committed while the Plaintiff was a bona fide resident of Tennessee or (2) were committed outside Tennessee, the Plaintiff was outside Tennessee at the time, and the Plaintiff has resided in Tennessee for six months next preceding the filing of the Complaint. As always, there are lots of complications and exceptions to these rules and often you will have to consult an attorney, if only to figure out where to file your divorce. |
