Steps in a Contested Divorce with Children
- A complaint for divorce is prepared, filed, and served by the sheriff on your spouse
- An answer must be filed within 30 days after service
- Each party must go to parenting class. There are many people that make a living doing this now
- Both parties must go to mediation.
- Both parties have to submit a parenting plan
- The discovery process must be completed. This includes interrogatories, depositions, requests for admissions, etc. by both parties
- The case may now be set for trial. Usually six to eight months away in urban areas and two or three months away in the country
- The case is tried and the judge decides your life for you and the children until they turn 18 and graduate from high school. Usually everyone is unhappy.
